Wise Carter has extensive experience in practically every aspect of utility litigation. We have represented utilities, including Entergy Mississippi, LLC, in electrical contact cases, customer cut-off cases, and utility right-of-way cases. Wise Carter has extensive experience with the National Electric Safety Code, the National Electric Code, and with experts that are effective in testifying as to the application of these codes.
In conjunction with the litigation experience, Wise Carter has a broad and deep level of understanding of the utility industry in general. As such, Wise Carter is often in a position to advise utilities on how to avoid litigation.
Mississippi Public Service Commission
Wise Carter represents clients before the Mississippi Public Service Commission (MPSC), which has regulatory authority over utility businesses in our state, including:
- Electrical utilities
- Gas utilities
- Water and sewer
- Motor carrier companies
We work primarily with the MPSC in matters involving local and state regulation of electricity generation, construction of facilities, service rules and regulations, and rates.
The Firm has been involved in this practice for over fifty years and was instrumental in establishing the statutes and regulations by which electric utilities are regulated in the state.
Wise Carter often advises Utilities on how to avoid litigation.
The firm also represents Public Utility Districts for local municipalities and counties. This representation includes eminent domain and related proceedings, which the firm has extensive experience with through its representation of electrical utilities over the years.
With regard to these Mississippi Public Service Commission matters, Wise Carter has successfully appealed these matters, when necessary, to the trial and appellate courts of Mississippi, and the United States Supreme Court.
Wise Carter also has, and is, litigating anti-trust and consumer protection claims brought against Entergy Mississippi, LLC with regard to the wholesale acquisition of power and the acquisition of generating plants.
Nuclear Regulatory Commission
Wise Carter has represented nuclear utilities in litigation seeking reimbursement of costs for the handling of spent nuclear fuels. We have also represented utilities before the Mississippi Public Service Commission in contested matters concerning certificates of necessity, rates, and terms of service.
Our attorneys represent nuclear plant owners and operators before the Nuclear Regulatory Commission (NRC). We work with NRC staff on a wide variety of licensing matters, and enforcement actions, and investigations, as well as whistle blower litigation before the Department of Labor.
Our attorneys have prepared and filed applications for changes in operations and ownership of nuclear plants and have an in-depth knowledge of transactions, such as plant decommissioning and management and service of contracts.
