Appellate Practice
About Wise Carter’s Appellate Group
Wise Carter’s Appellate Practice Group has many decades of experience in representing individual, business, and government clients in appeals before Mississippi’s appellate courts, several federal Courts of Appeals, and the Supreme Court of the United States. The group also handles appeals from administrative agencies.
Included in the group is a former Justice of the Supreme Court of Mississippi, who also taught a course on Appellate Practice for several years at the University of Mississippi Law School, an attorney who fulfilled a clerkship with the United States Supreme Court, and others who have clerked at the United States Court of Appeals for the Fifth Circuit and at the Court of Appeals of Mississippi.

- And more
Although appellate practice traditionally involves the representation of clients seeking to reverse or defend a judgment entered by a trial court following a trial, Wise Carter’s appellate practitioners are often involved from the very beginning of a lawsuit and work with trial counsel to draft initial pleadings, motions, and briefs so as to shape the issues presented with an eye toward ultimate review at the appellate level.
Regardless of where a client is in the litigation process, our attorneys can provide insight and assistance in laying the groundwork for success at the appellate level.
Interlocutory Petitions
We are experienced in filing (and responding to) emergency or interlocutory petitions seeking appellate courts’ review of trial court orders addressing issues ranging from venue and discovery disputes to jury selection or the exclusion of witnesses, as well as the merits of certain claims and defenses.
Trial Preparation
In addition, we assist in trial preparation and the trial itself by, for example, drafting jury instructions, briefing Daubert motions regarding expert testimony, and generally helping to ensure that the court record adequately reflects the information needed for appellate review and that points for appeal are preserved through timely motions or objections as may be appropriate.
Post-Trial Appeals
Of course, we handle post-trial appeals as well and are often hired only after judgment has been entered, and the appellate process is just beginning. Such requests may come from the parties facing an appeal or attorneys from other firms, including solo practitioners, who for various reasons want to have appellate counsel represent their clients in briefing an appeal or simply seek our help in serving as moot court judges in preparing them for argument before appellate courts.
In short, regardless of where a client may be in the litigation process, the attorneys in Wise Carter’s Appellate Practice Group can provide insight and assistance in laying the groundwork for success at the appellate level.
