Angela Cockerham Secures Repair Funds for Wilkinson County Roads and Bridges

Wilkinson County will soon have a bridge reopening that has been closed for over a year. Rep. Angela Cockerham, special counsel with Wise Carter, worked with the Wilkinson County Board of Supervisors and County Administrator, Bruce Lewis, to secure 1.7 million dollars to be utilized for emergency bridge and road repairs in the county.

Wilkinson County was awarded the funds during the 2018 First Extraordinary Session in Senate Bill 2002, which distributed BP oil settlement funds.

Congratulations to Mark Hodges and Charles Cowan for Successful Defense Verdict

Mark Hodges and Charles Cowan successfully defended an emergency department physician in a wrongful death medical malpractice trial that began on September 17, 2018 in Lamar County Circuit Court in Purvis, Mississippi.

The patient’s family sued for failure to diagnose a ruptured spleen, which ultimately caused the patient’s death. Plaintiff’s expert witness contended the defendant physician performed an inadequate examination of the patient and failed to order a CT scan of the patient’s abdomen during an emergency department encounter following an assault.

Defense experts testified the physician’s examination was adequate and that there was no clinical indication for a CT scan of the patient’s abdomen. After the parties’ presentation of their cases, the jury deliberated for less than half an hour before returning a unanimous defense verdict for the Wise Carter client physician.

Mississippi Supreme Court Rules to Reverse Division of Medicaid’s Decision

On Thursday, April 12, 2018, the Mississippi Supreme Court ruled to reverse the Division of Medicaid’s decision to use the Medicare blended rates in and to not exclude radiology and lab charges from the cost to charge ratio for OP services.

The Court remanded the case and “order[ed] the Executive Director to recalculate the Hospitals’ cost-to-charge ratio using the Hospital’s submitted costs in their cost reports, excluding laboratory and radiology services, and reimbursing the Hospitals the appropriate amounts determined using the State Plan.”

Wise Carter attorneys George Ritter and John Sneed served as counsel for the appellants, a group of twelve Medicaid-participating hospitals challenging the Department of Medicaid’s recalculation of their Medicaid outpatient rates.
