Mississippi Supreme Court Rules to Reverse Division of Medicaid’s Decision
On Thursday, April 12, 2018, the Mississippi Supreme Court ruled to reverse the Division of Medicaid’s decision to use the Medicare blended rates in and to not exclude radiology and lab charges from the cost to charge ratio for OP services.
The Court remanded the case and “order[ed] the Executive Director to recalculate the Hospitals’ cost-to-charge ratio using the Hospital’s submitted costs in their cost reports, excluding laboratory and radiology services, and reimbursing the Hospitals the appropriate amounts determined using the State Plan.”
