Gaye Nell Currie and Rex M. Shannon III successfully defended a medical malpractice claim against two nurse anesthetists. Plaintiff had claimed that the patient was overmedicated and was not properly monitored during a surgical procedure, leading to a respiratory and cardiac arrest.

As the nurses were employees of a public hospital, the matter was tried to the bench. The Court found that there was no negligence at issue, the patient had not been overmedicated, was properly monitored and that the patient had suffered a cardiac arrest after the surgical procedure, which was a consequence of his underlying medical condition.
