James C. Simpson, Jr. and T. Russell Nobile won an appeal involving the Harrison County Utility Authority (“HCUA”).

On January 14, 2014, the Mississippi Court of Appeals sided with the HCUA in a dispute over the use of eminent domain to take private property for post-Katrina infrastructure improvements built with Community Development Block Grant money.

Among other things, the ruling overturned 48,000 in attorney’s fees awarded against the HCUA and significantly reduced the risk of further liability arising out of related, secondary litigation against Wise Carter’s client and several private contractors.
